From theoretical approaches of organised crime to international and domestic legal term of criminal organisation

Abstract

The author examines in his paper the main theories on international organised crime and criminal organisations, results based on empiric researches, resp. the international and effective legal terms for criminal organisations. The goal of this paper is to show how much legal regulations can be applied for the several types of criminal organisations explored by researches. For this aim it offers a wide review about international and domestic theoretical approaches and research results, resp. Analyses appropriately the international and the domestic legal regulation. According to results of researches the international organised crime groups show manifoldness, different features in structure, aims, structure and other parameters are characteristic. Accordingly, the paper points out that the international definitions are wide enough and applicable for the different types of international criminal organisations, while on the other side – after the opinion of the author - the domestic legal definition can be narrowly interpreted, a considerable part of the multifarious international criminal groups is displaced without cause.
